Background

At the November 10, 2015 Clifton Park Planning Board Meeting, there was confusion about the location of the Land Preservation Area on 5 Dhara Court. The location is important because the homeowner cannot cut trees of build fences in the area. The Board Members were presented with a lot plan that showed a 40 foot area while a neighbor described a plan with a 50 foot buffer. The following email explains the confusion.

Plot Plan Confusion

At the November 10, 2015 Planning Board Meeting (agenda) there was confusion about the location of the Land Preservation Area for 5 Dhara Court. The owners showed a site plan with a 40 foot Land Preservation Area on the east side of their site. The neighbor to the east said that there was a newer site plan that showed a 50 foot Land Preservation Area.

Gentlemen,

I now understand the confusion about the 2 maps for the Longkill (Kain Preserve) Subdivision.

There are two maps on file with the County:

The 2011 (unrevised) map shows that the Land Preservation Area (LPA) is 40 feet + 10 feet deeded to Wassenaar (now Gendron). Note that the bottom dimension of the LPA is 398.89 ft.

The revised 2012 map shows that the LPA is 50 feet. The 10 feet deeded to Wassenaar is not part of the LPA. Notice that the bottom dimension of the LPA is 388.89 feet (10 feet less than the unrevised map).

The site plan (here is the tree clearing plan) given to the 5 Dhara Court residents is taken from the 2011 (unrevised) map. This the confusion.

The PDF's on the County site are difficult to read since they are full size drawings. I cropped out the relevant section of Sheet 2 from each and I've attached them. This should be easily verified by looking at the full size subdivision plan.
